1. This Website (“the Website”) is operated and controlled by the Durham, Gateshead, Newcastle Upon Tyne, North Tyneside, Northumberland, South Tyneside and Sunderland Combined Authority (“the Combined Authority”).

2. Use of the Website is governed by the terms of use detailed below (“the Terms”). If the user (“the User”) does not wish to accept and be bound by the Terms the User should exit immediately from the Website.

3. The Combined Authority may at any time revise these Terms. The User must review regularly the Terms to determine any changes, and continued use of the Website after any change has been made will be deemed to be acceptance by the User of that change.

4. The Combined Authority will endeavour to ensure that the Website is available at all times to the User and is as accurate as possible.

5. Disclaimer

5.1 The Combined Authority is providing the Website on an “as is” basis and makes no representations or warranties of any kind with respect to the Website or its contents and disclaims all such representations or warranties about the accuracy, completeness, suitability or compatibility for any purpose of the information and related graphics published in the Website. The information contained in the Website may contain technical inaccuracies or typographical errors. All liability of the Combined Authority howsoever arising for any such accuracies or errors is expressly excluded to the fullest extent permitted by law.

5.2 The Combined Authority does not guarantee or represent that access to the Website will be uninterrupted.

5.3 The Combined Authority expressly disclaims all liability for any direct, indirect or consequential loss or damage occasioned from the use or inability to use the Website, whether directly or indirectly resulting from inaccuracies, defects, viruses, errors whether typographical or otherwise, omissions, out of date information or otherwise.

5.4 Accessing the Website and downloading material from it is done entirely at the User’s own risk. The User will be entirely responsible for any resultant damage to software or computer systems and/or any resulting loss of data even if the Combined Authority has been advised of the possibility of such damage.

6.1 The Website may contain links to other websites over which the Combined Authority has no control. Such links are supplied solely for the convenience of the Users. The Combined Authority is not responsible for the contents or reliability of the linked websites and does not necessarily endorse the views expressed within them or the organisation or persons providing them. The Combined Authority does not guarantee that these links will work all of the time and it has no control over the availability of the linked pages.

6.2 Providers of other websites may place text-based links to pages on the Website without seeking the prior permission of the Combined Authority, but any such links must not open the Website pages into frames within another website. Pages from the Website must be loaded into the User’s entire browser window. The use of any logo of the Combined Authority or the logos of any associated or subsidiary organisations must not be used for promotional or linking purposes unless prior approval in writing has been given. 7. Jurisdiction

These Terms will be governed and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over disputes between a User and the Combined Authority arising out of the access or use of the Website. Omission by the Combined Authority to exercise any right under these Terms will not constitute a waiver of such right unless expressly stated by the Combined Authority in writing.

8. Copyright

Unless expressly stated the copyright and other intellectual property rights (including but not limited to design rights, trademarks and patents) in any material provided on the Website remain the property of the Combined Authority (or any other rightful owner). The material owned by the Combined Authority and published on the Website including but not limited to text and images, may not be printed, copied, reproduced, republished, downloaded, posted, displayed, modified, re-used, broadcast or transmitted in any way, except for the User’s own personal non-commercial use. Permission for any other type of use must be obtained from the Monitoring Officer who can be contacted on 0191 643 5339.
